OWL Terms of Service

1Who these terms are with, and what you are agreeing to

These terms are an agreement between you and Own What’s Left LLC (“we”, “us”), the maker of OWL, also called Own What’s Left.

They apply when you download, install or use the OWL desktop application, the OWL companion app for phones, our sync service, or the website at ownwhatsleft.com.

If you do not agree with these terms, do not use the software. If you are using OWL on behalf of a household, you are responsible for the people you share it with.

2What OWL is, and what it is not

OWL is budgeting software. It helps you plan where your money goes, record what you spend, reconcile against your statements, and see reports about your own figures.

OWL is not a bank and holds no money. We never take custody of funds, move money, or make payments on your behalf.

OWL is not financial, tax, investment or legal advice. It does arithmetic on numbers you supply and shows you the result. Any plan it produces, including a debt payoff schedule, is a projection based on what you entered. Decisions about your money are yours.

We do not guarantee any financial outcome. The software cannot know whether your figures are right, and it does not verify them against reality.

3Your data

Your budget lives on your own devices. What we do and do not collect is set out in full in our Privacy Policy, which forms part of these terms.

Three points matter enough to repeat here:

• No account is required to download or use OWL. An account exists only if you buy a license, and it holds your email and your license, nothing about your budget.
• When sync is on, your budget is encrypted on your device before it leaves, with a passphrase we never receive. We cannot read it.
• If you forget that passphrase, nobody can recover your budget, including us. This is deliberate. It is the price of us being unable to read your data. The printed Recovery Kit exists so you do not have to rely on memory, and we strongly recommend making one.

We never sell your information or give it to third parties. There is no advertising in OWL and there never will be.

4Backups are shared work, and the final responsibility is yours

OWL writes automatic local backups, can copy them into cloud storage that you own and control, and can sync between your own devices. Those tools exist because losing a budget is miserable.

Even so, you are responsible for keeping your own backups. Devices fail, drives fill, accounts get locked, and services we do not control can change. We are not liable for data you lose, and we cannot recover data we cannot read.

5The free software and the paid services

The budgeting software is free, and stays free. Budgeting, accounts, reconciling, reports, debt payoff, importing files from your bank, and backups to your own machine are not gated behind payment.

Some services cost money because they cost us money to run. These may include syncing through our servers, the phone companion, automatic bank feeds, assistance features, and the shared theme gallery. Which services are included in a subscription is stated at the point of purchase.

We may change which services are paid, but not retroactively. If a service you already pay for changes, we will tell you before your next renewal, and you can decline by canceling.

6Trials, licenses and your account

The free trial runs for 10 days from the day you start it on your account. One trial per account. No payment details are needed.

Buying a license creates an account. You buy on our website with an email address, and that account owns your license. The license is always visible when you are logged in, so a lost receipt never means a lost license. You secure the account with two-step verification.

A license covers one household. A household is the shared budget your devices connect to. Everyone in that household gets the services it covers, on as many of their own devices as they use.

A license covers you through its expiry day and stops the next day. There is no grace period. We warn you inside the application as the date approaches, and again on the day.

Some purchases are lifetime purchases, and here is exactly what that word means. You pay once and we never charge you again for it. It works for the operating life of the service: for as long as Own What’s Left LLC operates the OWL online services. It belongs to your household, and it does not renew, expire or come up for payment again.

If we ever shut the services down, we will give at least 30 days notice inside the application and on the website. During that time you can pull a final copy of your data from OWL Cloud Backup. After a shutdown, the free software keeps working on your devices, your budget stays yours, and your local backups and backups to cloud storage you own never depended on us at all.

Signing in activates it. Your account moves it. Signing in to your account inside OWL switches your paid services on for the budget linked to that account. To use your services on a different budget, unlink the old budget in your account, then sign in on the new one, where they continue for the time they have left. Nothing but your own account can move or take away a license.

You can move a license once every 90 days by unlinking it. Beyond that, contact us and we will help. This keeps one license from being passed around unrelated homes.

The price and billing period are whatever is shown on the purchase page when you buy. They are not restated here, so that a price change never requires rewriting these terms. A change never affects a period you have already paid for, and we will tell you before a renewal at a new price.

7Payment, renewal and cancellation

Payments are handled by our payment processor. We do not see or store your card number.

Subscriptions renew automatically at the end of each period unless you cancel. You can cancel at any time, and cancellation takes effect at the end of the period you have paid for.

Refunds. Your first purchase is fully refundable within 7 days, no reason required. A renewal charge is refundable within 48 hours. A free trial is there to decide before you buy, so these windows are for changing your mind, not for a second trial.

Disputes. A payment dispute filed with your card issuer or PayPal, rather than with us, permanently closes your account and revokes every license and subscription on it. Want your money back? Write to support@ownwhatsleft.com first. Refunds handled by us never affect your account.

If a payment is reversed or charged back, the license stops working and cannot be reactivated.

8What happens if a subscription ends

Nothing you have is taken away. This is a rule of the product, not a courtesy.

If your subscription lapses or you cancel:

• Your budget stays yours, in full, on your devices.
• The free software keeps working exactly as before.
• Paid services pause. Sync through our servers stops, and the phone stops receiving updates from other devices.
• Nothing is deleted, and starting a subscription again resumes the service.

9Bank connections, if you use them

If and when OWL offers automatic bank feeds, they are optional and off until you turn them on.

• You sign in at your bank, through a regulated aggregator. We never see, receive or store your banking username or password.
• You choose which accounts to connect, and you can disconnect any of them at any time from inside OWL.
• We may disconnect a bank connection that has gone unused.
• We receive transaction records for the accounts you connect, so the software can show them to you. What is received and how long it is kept is described in the Privacy Policy.
• Bank data is read-only. OWL cannot move money, make payments or change anything at your bank.
• Aggregators are third parties with their own terms. If one stops operating or drops support for your bank, the connection can end through no fault of ours, and file import remains available.

10Receipt scanning and assistance features

Receipt scanning reads a photograph on your own phone. The photograph never leaves your device and is not stored.

If you turn on the optional assistance features, limited text is sent to a service to be interpreted. We never send your ledger, your balances or your category names. These features are off until you switch them on, they act only when you ask, and anything they suggest is a suggestion you can edit or ignore. Nothing is saved until you save it.

11Using OWL properly

Please do not:

• resell, rent or redistribute the software or a license,
• share your account or license with a household that is not yours,
• try to defeat licensing, break into our servers, or disrupt the service for others,
• use OWL to break the law.

We may suspend or end a license for these, and section 8 still applies to your data: it stays yours.

12Availability, updates and beta software

We try to keep the sync service running and will not promise a percentage we cannot honor. Services can be interrupted for maintenance, by failures, or by third parties we depend on.

Updates arrive from time to time and can change or remove features. If we remove something you are paying for, section 5 applies.

Software marked beta or pre-release is unfinished by definition. Use it on data you have backed up.

13Warranty

The software is provided as it is. To the fullest extent the law allows, we make no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

Some places do not allow such exclusions, and in those places you may have rights this section cannot remove.

14Limit of what we owe you

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, savings or data, arising out of your use of OWL.

Where we are liable, our total liability is limited to what you paid us in the 12 months before the claim. For the free software that amount is nothing, which is what free means.

Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.

15Ending the agreement

You can stop using OWL at any time by uninstalling it. Your data is yours and you can export it first.

We can end this agreement if you break these terms. We will tell you why unless the law prevents it.

Sections 3, 4, 13, 14 and 16 continue to apply after the agreement ends.

16Changes to these terms

We may update these terms. If a change matters, we will say so in the application or by a notice on the website before it takes effect, and the effective date at the top always tells you which version you are reading.

Continuing to use OWL after a change means you accept it. If you do not, you can cancel and stop using it.

17Law and disputes

These terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws rules.

Talk to us first. If something is wrong, email us and give us 30 days to make it right before starting any formal dispute. Most problems end here.

Any dispute that does go further belongs in the state or federal courts located in Kentucky, and both sides agree to that venue. Either of us may still bring a matter that qualifies in small-claims court instead.

If you are a consumer, this section does not take away the mandatory protections of the law where you live. Those rights stand regardless of what this agreement says.
